Terms of Service

Welcome to Sparkle. These Terms of Service (the "Terms") form a binding agreement between you and the operator of Sparkle ("Sparkle", "we", "us" or "our"). By creating an account or using Sparkle in any way you agree to these Terms. If you do not agree, please do not use Sparkle.

1. What Sparkle is

Sparkle is an AI entertainment app. All profiles, messages, images and other content you receive in conversations on Sparkle are generated by artificial intelligence. There are no real human users on the other side of any conversation. Sparkle is not a dating, matchmaking or social-networking service, and is provided for entertainment and creative roleplay purposes only.

2. Eligibility

  • You must be at least 18 years old to use Sparkle.
  • You must have full legal capacity to enter into contracts in the country where you reside.
  • You must not be barred from using Sparkle under the laws of any jurisdiction that applies to you.

3. Your account

You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms or our community rules.

4. Coins, subscriptions and payments

  • Sparkle uses an in-app virtual currency ("Coins"). Coins are purchased with real money and are spent to send messages or unlock features. Coins have no monetary value outside Sparkle, are non-transferable, and cannot be redeemed for cash.
  • Subscriptions auto-renew until cancelled. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period.
  • Payment is processed by third-party payment providers (currently Whop). Their terms apply to the payment transaction itself.
  • Refunds. Because Coins and subscription content are digital and consumed immediately, all sales are final to the extent permitted by law. Statutory consumer rights (including the EU 14-day right of withdrawal, where applicable) are not affected; however, by using Coins or subscription content you expressly request immediate performance and acknowledge that you lose the right of withdrawal once content has been supplied.

5. Acceptable use

You agree not to use Sparkle to:

  • generate or solicit content depicting minors in any sexual or suggestive context;
  • generate content that promotes terrorism, extreme violence, self-harm, or hatred;
  • impersonate real, identifiable people without their clear consent;
  • scrape, reverse-engineer, or build derivative AI systems from Sparkle outputs;
  • use Sparkle for any illegal purpose, or in violation of any applicable law.

We may automatically moderate, block, hide, or remove content and may suspend accounts that violate this section.

6. AI-generated content

AI-generated content is, by its nature, unpredictable and may be inaccurate, offensive, biased or otherwise objectionable. Sparkle does not warrant that AI-generated content is accurate, safe, or fit for any particular purpose. Do not rely on anything an AI character tells you as fact, including any claim that the character is a real human. See our AI Disclosure for more.

7. Intellectual property

Sparkle, the Sparkle name and logo, the underlying software, and the design of profiles and characters are owned by Sparkle or its licensors. Subject to your compliance with these Terms, you receive a personal, non-exclusive, non-transferable, revocable licence to use the app for personal, non-commercial entertainment.

You retain ownership of content you submit (e.g. your messages), but grant us a worldwide, royalty-free licence to host, process and use that content as needed to operate, secure, and improve Sparkle, including by sending it to AI providers to generate replies.

8. Disclaimers

Sparkle is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Sparkle does not provide medical, mental-health, legal, financial or other professional advice and is not a substitute for any of those.

9. Limitation of liability

To the maximum extent permitted by law, Sparkle and its directors, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of Sparkle. Our aggregate liability to you for all claims relating to Sparkle will not exceed the greater of (a) the amounts you paid us in the 12 months preceding the claim, or (b) EUR 50.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law (such as liability for gross negligence, intentional misconduct, or death or personal injury caused by negligence).

10. Termination

You can stop using Sparkle and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if we are required to do so by law. Sections intended to survive termination (including IP, disclaimers, liability and dispute resolution) will continue in effect.

11. Governing law and disputes

These Terms are governed by the law of the jurisdiction in which Sparkle's operating entity is established, without regard to conflict-of-laws rules. Mandatory consumer- protection rules of your country of residence continue to apply. Disputes will be resolved in the competent courts of that jurisdiction, except where mandatory law provides otherwise.

12. Changes

We may update these Terms. Material changes will be communicated in-app at least 14 days before they take effect. Continued use of Sparkle after the effective date constitutes acceptance.
